MANILA, Apr 1 (Mabuhay) — The Sandiganbayan on Wednesday allowed detained Sen. Jinggoy Estrada to leave Camp Crame to undergo an emergency medical examination at the Cardinal Santos Memorial Medical Center in San Juan City.
In a resolution, the anti-graft court’s Fifth Division permitted Estrada to leave the Philippine National Police Custodial Center from 3 p.m. to 6 p.m. Wednesday, for a checkup on his “unbearably painful” shoulder.
“After taking into account the arguments of both parties and for humanitarian considerations, the Court resolves to grant accused-movant’s prayer over the objection of the prosecution,” part of the resolution reads.
“As prayed for, accused Jinggoy E. Estrada is allowed to leave his place of detention at the PNP Custodial Center, Camp Crame and to proceed to the Cardinal Santos Memorial Hospital at Greenhills, San Juan City to undergo a clinical examination for three (3) hours, today, April 1, 2015 from 3:00 o’clock in the afternoon up to 6:00 o’clock in the evening,” it added.
But the court has imposed certain rules on the temporary furlough, including limiting Estrada’s movement to the hospital and his detention cell only.
“The Philippine National Police shall see to it that accused Estrada will not go to any other place other than the Cardinal Santos Memorial Hospital at Greenhills, San Juan City,” the court said.
Also, it directed Estrada and his lawyers to submit a medical certificate on the result of the examination within five days from Wednesday.
It also noted that if Estrada’s check up is over before the allotted time expires, he is to be brought back to Camp Crame immediately.
“Accused Estrada shall be transported from his detention cell at Camp Crame, Quezon City, not earlier than 3:00 o’clock in the afternoon, today, April 1, 2015, to the Cardinal Santos Memorial Hospital at Greenhills, San Juan City, and he will be allowed to stay thereat for three hours only, not to go beyond 6:00 o’clock in the evening, and thereafter be returned immediately to his detention cell at Camp Crame. In case the medical examination will be completed in less than three hours, the PNP should not wait for 6:00 o’clock but immediately transport the accused to his detention cell,” the resolution said.
Estrada is also barred from granting any interviews, and that the PNP was tasked to monitor closely his use of communication gadgets.
The senator, who is accused of graft and plunder for allegedly participating in the multi-billion peso pork barrel scam, is to shoulder all necessary expenses during his trip.
Estrada had requested for the temporary furlough to have his left shoulder checked, saying it has been causing him unbearable pain. The prosecution had objected to the motion. (MNS)
